Terms of Service

1. Definitions

In these Terms of Service, the following definitions apply:

• "Furnostyles," "we," "us," or "our" refers to Furnostyles Luxe Designs, a business registered and operating in Nairobi, Kenya.
• "Platform" refers to the Furnostyles website at furnostyles.com, its sub-pages, mobile interfaces, and any associated digital services.
• "User," "you," or "your" refers to any individual or entity accessing or using the Platform.
• "Buyer" means a User who purchases or seeks to purchase products or services through the Platform.
• "Vendor" means a registered seller or service provider listing products or services on the Marketplace.
• "Marketplace" refers to all commercial listing areas on the Platform including furniture, materials, services, sourcing, secondhand, and real estate sections.
• "Services" means repair, installation, interior design, renovation, and professional services offered through or facilitated by Furnostyles.
• "Content" means all text, images, videos, descriptions, pricing, and other materials submitted, posted, or displayed on the Platform.

2. Acceptance of Terms

By accessing the Platform, creating an account, placing an order, submitting a listing, or otherwise using any feature of Furnostyles, you confirm that:

• You have read, understood, and agree to these Terms of Service.
• You are at least 18 years of age, or are accessing the Platform under the supervision of a parent or legal guardian who has agreed to these Terms.
• You have the legal capacity to enter into a binding contract under the laws of Kenya.
• You consent to our Privacy Policy, which is incorporated into these Terms by reference.

If you are using the Platform on behalf of a business, you represent that you are authorised to bind that business to these Terms.

3. Platform Use & Eligibility

The Furnostyles Platform is intended for use by individuals and businesses in Kenya and, where applicable, internationally. You agree to use the Platform only for lawful purposes and in accordance with these Terms.

3.1 Permitted Use

• Browsing and purchasing products and services.
• Listing products and services as a verified vendor or service provider.
• Submitting enquiries, quotes, and service requests.
• Accessing educational content, guides, and inspiration materials.

3.2 Restricted Use

You may not use the Platform to:

• Engage in fraudulent, deceptive, or misleading activities.
• Circumvent the Platform's transaction system or contact vendors/buyers outside the Platform to avoid fees.
• Scrape, crawl, or harvest data without prior written consent.
• Distribute spam, phishing messages, or unsolicited communications.
• Impersonate Furnostyles staff, other users, or any third party.

4. User Accounts

Certain features of the Platform require you to create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your password and account credentials.
• Notify Furnostyles immediately of any unauthorised use of your account.
• Accept responsibility for all activities that occur under your account.

Furnostyles reserves the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or otherwise harm the Platform community.

5. Marketplace Rules

5.1 Listing Accuracy

All product and service listings must be accurate, complete, and not misleading. Vendors must provide correct descriptions, images, pricing, availability, and delivery timelines. Furnostyles reserves the right to remove any listing that is inaccurate, inappropriate, or violates these Terms.

5.2 Pricing

All prices displayed on the Marketplace are in Kenyan Shillings (KES) unless otherwise stated. Prices are inclusive of applicable taxes where noted. Furnostyles is not responsible for pricing errors made by individual vendors, though we will endeavour to resolve such errors fairly.

5.3 Availability

Product availability is not guaranteed until an order is confirmed. Furnostyles and its vendors reserve the right to cancel orders where items are out of stock, and a full refund will be issued in such cases.

6. Vendor & Service Provider Rules

Vendors and service providers on the Furnostyles Marketplace must:

• Be legally registered or eligible to trade in Kenya.
• Complete the Furnostyles verification process before listing.
• Comply with all applicable Kenyan consumer protection and trade laws.
• Maintain accurate inventory and service availability information.
• Honour all confirmed orders and service bookings.
• Respond to customer enquiries within 24 hours of receipt.
• Comply with the Vendor Policy in full.

Furnostyles reserves the right to de-list vendors who receive consistently poor reviews, fail to fulfil orders, or violate these Terms.

7. Orders, Payments & Pricing

7.1 Order Placement

Placing an order constitutes an offer to purchase. Orders are confirmed only once payment is received or an explicit written confirmation is issued by Furnostyles or the vendor.

7.2 Accepted Payment Methods

Furnostyles accepts M-Pesa, bank transfer, cash (for in-person transactions), card payments, PesaPal, and Airtel Money. Additional payment methods may be added over time.

7.3 Invoicing

An invoice or receipt will be provided for all confirmed transactions. Please retain this for warranty and return purposes.

7.4 Pricing Changes

Furnostyles and its vendors reserve the right to change prices at any time. Price changes do not affect confirmed orders already placed.

8. Delivery & Services

Delivery timelines and service scheduling are estimates and may be affected by location, availability, and circumstances beyond our control. For specific delivery terms, refer to our Shipping Policy. For service bookings, refer to our Service Policy.

Furnostyles currently delivers to all major towns in Kenya. International delivery is available by arrangement. Installation and setup services are available in Nairobi and surrounding areas.

9. Intellectual Property

All content on the Furnostyles Platform — including but not limited to logos, designs, text, photography, software, and data — is the property of Furnostyles or its content suppliers and is protected by Kenyan and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written permission from Furnostyles. Vendors retain ownership of their own listing content but grant Furnostyles a non-exclusive licence to display, promote, and distribute that content through the Platform.

10. Prohibited Activities

The following activities are strictly prohibited on the Furnostyles Platform:

• Listing counterfeit, stolen, or illegally obtained goods.
• Engaging in price manipulation, bid rigging, or collusion with other vendors.
• Leaving false or misleading reviews.
• Using the Platform to distribute malware, viruses, or harmful code.
• Attempting to gain unauthorised access to user data, accounts, or backend systems.
• Selling prohibited items including weapons, narcotics, or items banned under Kenyan law.
• Conducting transactions outside the Platform to avoid Furnostyles fees or protections.

Violations may result in immediate account suspension, legal action, and reporting to relevant authorities.

11. Limitation of Liability

To the maximum extent permitted by law, Furnostyles shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
• Loss of profits, data, or business opportunities.
• Actions or omissions of third-party vendors or service providers listed on the Platform.
• Service interruptions, technical errors, or Platform unavailability.

Furnostyles' total liability to you for any claim arising from use of the Platform shall not exceed the total amount paid by you in the three months preceding the claim. This limitation does not exclude liability for death or personal injury caused by Furnostyles' negligence, or fraud.

12. Dispute Resolution

In the event of a dispute, we encourage you to first contact Furnostyles at furnostyles@gmail.com or call +254 713 639 205 to seek an amicable resolution.

If a resolution cannot be reached directly, disputes will be handled in accordance with our Dispute Resolution Policy. Unresolved disputes will be subject to the jurisdiction of the courts of Kenya.

13. Termination

Furnostyles may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice, if we believe you have violated these Terms or engaged in activities harmful to the Platform, other users, or Furnostyles.

You may terminate your account at any time by contacting us. Termination does not relieve you of obligations for transactions already in progress.

14. Governing Law

These Terms of Service are governed by the laws of the Republic of Kenya. Any legal proceedings arising from these Terms shall be brought before the competent courts in Nairobi, Kenya, unless otherwise required by applicable law.

15. Changes to These Terms

Furnostyles reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

For material changes, we will endeavour to notify registered users via email or a prominent notice on the Platform.
